    According to the new rules, businesses that received prior COVID relief funds are still eligible to qualify for the ERC.

    FALSE: We were not forced to shut down our operations fully or partially, so we can’t qualify.

    Business operations did not have to cease entirely for your business to qualify. Issues arising with interrupted services such as supply chain shortages that prevented or delayed your business profits apply to the government’s definition of “partial shutdown.”

    FALSE: We fall under the essential business category so we can’t qualify for any relief.

    If your business satisfies the Government Orders Test or Gross Receipts Test, any business sector (except the government) may be eligible to receive funds because the ERC program does not distinguish between essential and non-essential businesses.

    FALSE: Our business became more profitable, so we do not qualify.

    An increase in profitability does not impact your eligibility to qualify for the ERC. In fact, the ERC does not require a loss of profit to qualify, so long as your business falls under one of the three categories mentioned above.
